These Terms and Conditions (“Terms”) govern access to and use of the BotClub website, applications, digital platforms, educational content, physical learning products and related services.
“BotClub”, “we”, “our” and “us” refer to BotClub Private Limited, operating under the BotClub brand.
BotClub’s products and services/brands may include:

If you do not agree, do not use the relevant service. If you are using a product on behalf of a school, company or other organisation, you confirm that you are authorised to accept these Terms on its behalf. A separate written agreement may apply to institutional purchases or deployments.

2. Eligibility and Accounts

Certain services may be intended for teachers, school administrators, parents, students or other users. Access to particular features may be subject to age restrictions, school permissions or additional requirements.
You agree to:
● Provide accurate information when registering or purchasing.
● Keep your login credentials confidential.
● Use only accounts you are authorised to access.
● Notify us promptly of suspected unauthorised access.
● Keep account and contact information reasonably up to date. You must not impersonate another person, create accounts through unauthorised means, or allow unauthorised individuals to use your account.
For school-managed accounts, the school or its authorised administrator may create, manage, suspend or remove accounts in accordance with the applicable school agreement and law.

3. Scope of Services

BotClub provides educational products and services that may combine physical models, activity books, interactive simulations, classroom software, lesson-planning tools, AI-assisted features, dashboards and related support.
Features vary by product, subscription, device, licence, school arrangement and software version. Not every feature described on our website will necessarily be available in every plan or deployment.
We may update, improve, maintain or modify services from time to time. Where a change materially affects a paid service, we will act in accordance with the applicable agreement and law.

4. Orders, Quotes and Institutional Purchases

Product descriptions, demonstrations, brochures and website listings are intended to explain the general nature of our offerings. The final items, quantities, configuration, pricing, delivery arrangements and support commitments will be determined by the accepted quotation, order confirmation, invoice or signed agreement.
For school and institutional purchases:
● The quotation or purchase order should identify the products and quantities.
● Any installation, training, subscription term, renewal, support or warranty commitments should be documented in the relevant order or agreement.
● Where these Terms conflict with a signed institutional agreement, the signed agreement will prevail for the conflicting subject matter.
An enquiry, demonstration or quotation does not itself constitute a confirmed purchase unless accepted in accordance with the stated order process.

5. Pricing, Taxes and Payments

Prices, applicable taxes, delivery charges and payment schedules will be shown in the relevant quotation, order or checkout process.
Unless otherwise agreed in writing:
● Payments must be made using the payment method and within the period specified in the invoice or checkout.
● The customer is responsible for applicable taxes and charges disclosed before purchase.
● Access to a subscription or paid service may depend on receipt of payment.
● Any late-payment consequences must be set out in the applicable order or agreement and will be subject to applicable law.
We may correct genuine pricing or listing errors before accepting an order. If an order has already been accepted and a material error is discovered, we will contact the customer to resolve it in accordance with applicable law

6. Subscriptions, Renewals and Cancellation

Some software and digital services may be offered on a monthly, annual or other subscription basis.
The applicable order or subscription page will specify the subscription price, duration, billing frequency, renewal arrangements and cancellation process.
Unless expressly stated, a subscription does not include ownership of the underlying software or intellectual property.
Customers may cancel a subscription using the stated cancellation process. Cancellation will take effect according to the applicable order terms. Any refund, partial refund or access following cancellation will be determined by the disclosed subscription terms and applicable law.
We will not rely on these Terms to exclude any refund or cancellation right that cannot lawfully be excluded.

7. Delivery, Installation and Physical Products

Physical products may include science models, educational kits, books, accessories and classroom devices.
Delivery timelines, shipping charges, installation, assembly, training and acceptance requirements will be stated in the relevant quotation or order.
Customers should inspect delivered products within a reasonable time and notify BotClub of missing items, transit damage or apparent defects using contact@botclub.in .
Physical models and classroom kits should be used for their intended educational purposes and in accordance with supplied instructions. Teachers or responsible adults should supervise student use where appropriate.
Unless specifically stated in writing, a product should not be treated as a certified laboratory instrument, safety device or substitute for professional equipment.

8. Returns, Refunds and Warranty

Return eligibility, warranty coverage, exclusions, repair or replacement procedures and refund timelines will be stated in the applicable product listing, quotation, warranty document or order.
Customers should contact contact@botclub.in with the order number, product details and a description of the issue.
Nothing in these Terms limits any mandatory consumer right or remedy available under applicable law. If no separate warranty is supplied, customers should obtain written confirmation of the applicable warranty terms before purchasing.
Digital services, activated subscriptions, customised products and physical products may have different return conditions, subject to applicable law and any express written commitment.

9. Permitted Use of Educational Content and Software

Subject to these Terms and any applicable licence, BotClub grants the customer a limited, non-exclusive, non-transferable right to use the relevant software and digital content for the intended educational purpose during the applicable licence period.
Unless we expressly authorise it in writing, you must not:
● Copy, resell, sublicense, distribute or commercially exploit our software or content outside the permitted licence.
● Reverse engineer, decompile or attempt to extract source code, except where such restriction is prohibited by law.
● Circumvent access controls, security measures or licence restrictions.
● Use our services to distribute malware, unlawful content or harmful material.
● Interfere with the operation, security or availability of our platforms.
● Use automated tools to scrape, copy or extract substantial portions of our content or services without permission.
● Remove copyright notices, trademarks or other proprietary notices.
Schools may use licensed content for their authorised educational activities within the scope of the relevant licence. Any broader reproduction, redistribution, public posting or commercial use requires appropriate permission.

10. Intellectual Property

BotClub and its licensors retain all rights in their software, source code, designs, simulations, models, videos, illustrations, books, text, graphics, interfaces, trademarks, logos, documentation and other proprietary materials, except for materials owned by third parties or users.
Purchasing a physical product does not transfer ownership of the intellectual property embedded in or associated with that product.
The names BotClub, Luminary, SkolAR Labs, SkolAR Teach, SolvE’d and Super Teacher, together with their logos and branding, may be protected by applicable intellectual property laws.
You may not use our trademarks or branding in a way that suggests an unauthorised partnership, endorsement or affiliation.

11. User-Submitted Content

You may submit lesson material, prompts, questions, feedback or other content when using our services.
You retain any rights you already hold in your content. You grant BotClub permission to host, process, transmit and display that content to the extent reasonably necessary to provide the service, comply with law, maintain security and perform the relevant agreement.
You confirm that you have the rights and permissions needed to submit the content and that doing so does not violate another person's rights or applicable law.
Do not submit confidential school records, personal information about students or third-party copyrighted material unless you have the necessary authority and the submission is appropriate for the feature being used.
Any use of user content for optional product improvement, analytics or AI-model training must be governed by the applicable privacy notice, product settings and any required consent or contractual permission. These Terms do not independently authorise unrestricted use of student data for model training.

12. AI-Generated Content and Educational Limitations

Some services may generate explanations, lesson material, questions, solutions, summaries or other outputs using artificial intelligence.
AI-generated outputs may be inaccurate, incomplete, outdated or inappropriate for a particular context. They may not always reflect the correct curriculum, syllabus, examination method or expected answer.
You agree that:
● Teachers and responsible adults should review AI-generated classroom material before use.
● Students should use AI explanations as learning support rather than as a guarantee of a correct answer.
● Users should independently verify important educational, technical or factual information.
● AI outputs should not be treated as guaranteed examination results, professional advice or a substitute for teacher judgement.
BotClub does not guarantee that AI-generated material will be error-free, that every question will be answered, or that a student will achieve a particular academic outcome.
Where an AI feature relies on a third-party provider, its availability and processing may also depend on that provider's systems and terms.

13. Student Safety and School Responsibilities

Schools and other institutions are responsible for determining whether a product is appropriate for their setting and for supervising its use by students.
Where applicable, schools should:
● Ensure students use products in an age-appropriate and supervised manner.
● Manage account permissions and access to student information.
● Obtain or facilitate required parent or guardian permissions.
● Follow product instructions and classroom safety guidance.
● Avoid uploading student information that is unnecessary for the service.
BotClub will handle personal data in accordance with its Privacy Policy and applicable law. These Terms do not remove any legal obligation that rests on BotClub, a school or another party.

14. Availability, Maintenance and Support

We aim to provide reliable services but do not guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, connectivity issues, software updates, third-party outages, security incidents or circumstances beyond our reasonable control.
Support channels, service levels, response times and maintenance commitments will be as stated in the applicable plan or written agreement. If no service level is expressly agreed, support will be provided on a reasonable-efforts basis.
Customers are responsible for maintaining compatible devices, appropriate internet connectivity and any third-party software or equipment identified as necessary for the service.

15. Privacy and Personal Data

Your use of our services is also governed by the BotClub Privacy Policy, available at Privacy Policy
The Privacy Policy explains how personal data may be collected, used, disclosed, retained and protected.
If you are a school or institution providing information about students, teachers or other individuals, you must have the authority and permissions required to provide that information and must comply with applicable data-protection obligations.

16. Third-Party Services and Links

Our services may link to or integrate with third-party websites, payment providers, AI providers, communication platforms, devices or other services.
Third-party services may be governed by their own terms and privacy policies. BotClub is not responsible for independent third-party services beyond the responsibilities imposed by applicable law or an express written agreement.
The availability of a third-party link or integration does not necessarily mean that BotClub endorses every product, statement or service offered by that third party.

17. Suspension and Termination

We may suspend or restrict access where reasonably necessary to investigate suspected fraud, protect users or systems, address security risks, comply with law, enforce these Terms or respond to a material breach of an applicable agreement.
Where appropriate and legally permitted, we will provide notice and a reasonable opportunity to address the issue.
A customer may stop using a free service at any time and may cancel a paid service according to the applicable order or subscription terms.
Termination does not automatically extinguish payment obligations already incurred, rights that accrued before termination or provisions that by their nature should continue, including intellectual property, confidentiality, lawful limitations of liability and dispute provisions.
Data handling following termination will be governed by the Privacy Policy, applicable law and any relevant institutional agreement.

18. Disclaimers

To the extent permitted by applicable law, the website and services are provided on an “as available” basis.

We make reasonable efforts to maintain accurate product information and reliable services. However, we do not warrant that every service will be uninterrupted, compatible with every device, free of all errors or suitable for every individual teaching or learning requirement.

Product images, illustrations and demonstrations are representative unless expressly stated to be exact specifications. Actual appearance, packaging or configuration may vary within the description and specifications of the purchased product.

Nothing in this section excludes a statutory guarantee or consumer protection that cannot lawfully be excluded.

19. Limitation of Liability

To the extent permitted by applicable law, BotClub will not be liable for indirect or consequential losses, loss of anticipated profits, loss of data or business interruption arising from use of a service, except where such liability cannot lawfully be excluded.

Subject to applicable law, any limitation of direct liability for a paid product or service should be set out in the relevant quotation or written agreement. If no separate limitation is agreed, liability will be determined under applicable law.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury where exclusion is unlawful, infringement of non-excludable statutory rights, or any other liability that cannot legally be limited.

20. Indemnity

To the extent permitted by law, a business or institutional customer may be responsible for losses directly arising from its unlawful use of the services, its material breach of these Terms, or content it submits without the necessary rights or permissions.

This section does not require a consumer to waive statutory rights or accept liability that cannot lawfully be imposed.

21. Changes to These Terms

We may update these Terms when our products, services or legal obligations change. The revised version will be published on our website with an updated date.

Where required by law or an applicable agreement, we will provide notice of material changes. Changes will not override an existing signed agreement unless permitted by that agreement or separately accepted by the relevant parties.

These Terms are governed by the laws of India.

The parties will attempt to resolve disputes through good-faith discussions. If a dispute cannot be resolved, it may be submitted to the competent courts having jurisdiction under applicable law at Visakhapatnam, A.P, India.

Nothing in this clause restricts a consumer from approaching a competent consumer forum or exercising any other mandatory statutory remedy available under applicable law.

24. Severability and Waiver

If a provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permissible.

A failure to enforce a provision on one occasion does not waive the right to enforce it later

25. Entire Agreement

These Terms, together with the Privacy Policy and any applicable quotation, order, subscription terms, warranty or signed institutional agreement, form the applicable agreement for the relevant service.

Where an express written institutional agreement conflicts with these Terms, that agreement will prevail to the extent of the conflict.
